1. Who we are
PetPerksClub Ltd ("PetPerksClub", "PetPerks", "we", "us", "our") operates under the trading name "PetPerks" and provides members access to discounts and offers from third-party partners ("Partners") via our website and app (the "Service").
2. Eligibility
2.1 You must be at least 18 years old to purchase a membership.
2.2 You must provide accurate, current information and keep it updated.
3. Membership plans and renewal
3.1 Membership is available on monthly or annual subscriptions ("Membership").
3.2 Memberships auto-renew at the end of each billing period unless you cancel before renewal.
3.3 We may offer trial periods, promotions, or discount codes at our discretion. Any promotion may be withdrawn or changed at any time.
4. Billing, payments, and authorisation
4.1 Payments are processed by our payment provider (e.g., Stripe). By subscribing, you authorise recurring charges at the displayed price and frequency.
4.2 If a payment fails, we may suspend access until payment is successfully processed.
4.3 You are responsible for any bank or card charges you incur.
5. Cancellation
5.1 You can cancel anytime through your account settings (or where provided) or by contacting support.
5.2 Cancellation takes effect at the end of your current billing period. You will retain access until then.
5.3 If you cancel, you will not be charged again unless you re-subscribe.
6. Refunds and cooling-off rights
6.1 General rule: We do not provide refunds for unused time in a billing period, including annual plans, except where required by law.
6.2 UK consumer rights: If you are a UK consumer, you may have a 14-day cooling-off right for distance sales unless an exception applies.
6.3 Immediate access: Where you are given immediate access to membership benefits this may affect your cancellation right once the Service is supplied.
6.4 Nothing in these Terms limits your statutory rights.
7. Member benefits and Partner offers
7.1 Membership provides access to offers made available by Partners. Offers may include online discounts, in-store discounts, vouchers, or other promotions.
7.2 Offers are provided by Partners, not by us. Partners control offer availability, pricing, exclusions, opening times, redemption methods, stock, appointment availability, and eligibility.
7.3 Offers may be changed, paused, or withdrawn at any time. We do not guarantee any specific offer will be available at any time.
7.4 Partners may impose their own terms. If there is a conflict, Partner terms apply to that specific offer.
8. Non-transferability, account sharing, and misuse (this is the "mate rate" clause)
8.1 Your Membership is personal and non-transferable.
8.2 You must not:
- share your login, subscription access, QR code, verification link, Pair Code, or membership credentials with anyone else;
- allow a friend/family member to redeem your benefits (online or in-store);
- attempt to bypass device limits, verification checks, or security features;
- resell, trade, or advertise access to PetPerks benefits.
8.3 We may use device pairing, verification pages, time-limited tokens, usage rules, and other checks to reduce abuse.
8.4 If we reasonably believe there is misuse, we may suspend or terminate your Membership without refund, and we may block devices/accounts associated with that misuse.
9. One-device policy (your chosen rule)
9.1 By default, Membership access via our app is limited to one device per member.
9.2 If you change phone/device, you may need to re-link. Additional devices may require support approval.
9.3 If our systems detect multiple devices using the same Membership, we may suspend access pending verification.
10. In-store verification and ID checks
10.1 Some offers require in-store verification (e.g., a QR code or browser verification page).
10.2 Partners may request reasonable verification to prevent fraud (e.g., matching name on membership to payment card or photo ID). We do not control Partner verification practices.
11. Your responsibilities
11.1 You are responsible for keeping your device secure and preventing unauthorised access.
11.2 You must use the Service lawfully and not interfere with its operation (no scraping, reverse engineering, automated attacks, etc.).
11.3 You must not use the Service to harass Partners, abuse staff, or make fraudulent reservations/appointments.
12. Suspension and termination
12.1 We may suspend or terminate your access immediately if:
- you breach these Terms;
- we reasonably suspect fraud, misuse, or account sharing;
- required by law or to protect the Service, Partners, or other members.
12.2 Where appropriate, we may reinstate access once the issue is resolved. Reinstatement is at our discretion.
13. Chargebacks and payment disputes
13.1 If you raise a chargeback or payment dispute without first contacting us, we may suspend your Membership while the dispute is investigated.
13.2 We may provide evidence to the payment provider including account activity, verification logs, and access records.
14. Service availability and changes
14.1 We aim to keep the Service running smoothly, but we do not guarantee uninterrupted availability.
14.2 We may update, change, or discontinue parts of the Service (including the app, verification methods, or offers) at any time.
15. Limitation of liability
15.1 We provide the Service on an "as is" basis.
15.2 To the fullest extent permitted by law, we are not liable for:
- Partner actions/omissions, service quality, cancellations, pricing, or exclusions;
- indirect or consequential loss (e.g., lost profits, loss of goodwill);
- delays or failures caused by events outside our reasonable control.
15.3 Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under law.
16. Complaints and disputes with Partners
16.1 If you have a complaint about a Partner's product/service, you must raise it with the Partner directly.
16.2 If an offer is not honoured, contact us with details and we may investigate, but we are not responsible for Partner decisions.
17. Privacy and data
17.1 We process personal data in accordance with our Privacy Policy.
17.2 We may collect technical and device information for security, fraud prevention, device linking, and service improvement.
18. Changes to these Terms
18.1 We may update these Terms from time to time.
18.2 If changes are material, we will take reasonable steps to notify you (e.g., email or in-app notice).
18.3 Continued use of the Service after changes means you accept the updated Terms.
19. Governing law
These Terms are governed by the laws of England and Wales. Courts of England and Wales have exclusive jurisdiction, unless mandatory consumer rules apply.
